Sign Waiver Terms & Condition
In consideration of being allowed to participate in the activities offered by Flipped, I, the undersigned, hereby acknowledge and agree to the following for me and my dependents;
a) I understand that the activities and services that are offered by Flipped, including but not limited to trampolining, soft play areas, and other entertaining activities, involve inherent risks, including the risk of bodily injury, disability, or death, and I voluntarily assume all such risks.
b) I am fully aware of the services, equipment, and/or other facilities that are offered at the Flipped. I acknowledge that participation in activities at Flipped, for myself and any dependents, involves inherent risks, including the potential for physical harm, injury, disfigurement, and even death. I understand these activities are strenuous, potentially dangerous, and require physical ability, maturity, and skill. I recognize that Flipped does not assess or recommend my fitness level for participation in these activities.
c) I understand and agree that any data collected by Flipped, including but not limited to videos, pictures, information, interviews, customer reviews, and feedback of myself, my family, or dependents, may be utilized by Flipped`s marketing and business team for publications, advertisements, and promotions on various social media platforms such as Facebook, Instagram, Snapchat, and Twitter. By signing this waiver, I grant Flipped permission to record, store, transmit, reproduce, replicate, modify, advertise, and exploit all such data for the benefit of the Flipped brand. It is expressly understood that the collected data will not be used to insult, defame, or slander any person.
d) I, on behalf of myself, my heirs, assigns, representatives, dependents and next of kin, hereby waive, release, and discharge Flipped, its owners, officers, directors, employees, agents, and representatives from any and all claims, liabilities, damages, costs, or expenses, including but not limited to medical expenses and attorneys` fees, arising out of or in connection with my participation in the activities offered by Flipped, whether caused by the negligence of Flipped or otherwise.
e) If I am signing this waiver on behalf of any dependents, including underaged children, I hereby agree to assume full responsibility for their participation in the activities offered by Flipped, and I further agree to indemnify and hold harmless Flipped from any and all claims arising out of or in connection with their participation in such activities.
f) I understand and agree that any data collected by Flipped, including but not limited to videos, pictures, information, interviews, customer reviews, and feedback of myself, my family, or dependents, may be utilized by Flipped`s marketing and business team for publications, advertisements, and promotions on various social media platforms such as Facebook, Instagram, Snapchat, and Twitter. g) I agree to comply with all rules, regulations, and instructions provided by Flipped and its employees or agents regarding the use of its facilities and participation in its activities.
h) This waiver and release shall be governed by and construed in accordance with the laws of the United Arab Emirates.
i) I acknowledge the importance of consulting a doctor before engaging in physical activities. I confirm that neither I nor my dependents have any medical conditions or incapacities that would hinder our participation in Flipped activities. This includes conditions such as heart issues, epilepsy, allergies, skeletal or spinal injuries, or any other medical conditions posing risks during participation. Pregnant individuals are not permitted to partake in Flipped activities. I accept legal responsibility for myself and/or my dependents and agree to indemnify Flipped from any litigation arising from my dependents` participation. I agree not to initiate litigation against Flipped and agree to cover any legal costs incurred by Flipped in defense of such litigation.
*I HAVE CAREFULLY READ THIS WAIVER AND RELEASE OF LIABILITY AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT BY SIGNING THIS DOCUMENT, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, AND I SIGN IT VOLUNTARILY.
